What the Repeal Actually Does
The Social Security Fairness Act (Public Law 118-273) eliminates both the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) for benefits payable starting January 2024. Millions of federal retirees, state/local public servants, and teachers who previously saw reduced or zero Social Security benefits are now eligible for restored payments plus retroactive back pay.
- WEP — previously reduced your own Social Security benefit if you also received a pension from non-covered employment (e.g. CSRS).
- GPO — previously reduced or eliminated spouse/survivor benefits by 2/3 of the non-covered pension.
- Back pay — SSA is issuing retroactive payments covering January 2024 forward. Most recipients should see their adjusted monthly benefit plus a lump-sum catch-up.
